Welcome to Thiumana Nikah Matrimony (herein referred to as TNM).
This document is an electronic record in terms of the Information Technology Act, 2000, and rules thereunder pertaining to electronic records as applicable and amended. This electronic record is generated by a computer system and does not require any physical or digital signatures.
This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries Guidelines) Rules, 2011, that require publishing the rules and regulations, privacy policy, and the terms and conditions for access or usage of http://thirumananikah.com/ (the "Website/Applications" (APP)).
Please read the following terms and conditions very carefully as your use of the Website and associated TNMServices (as defined below) is subject to your acceptance of and compliance with the following terms and conditions including the applicable policies which are incorporated herein by way of reference and as amended from time to time (the "Terms and conditions"). ACCESSING, BROWSING, OR OTHERWISE USING THE WEBSITE INDICATES YOUR AGREEMENT TO ALL THE TERMS AND CONDITIONS herein, SO PLEASE READ THE TERMS and conditions CAREFULLY BEFORE PROCEEDING. By impliedly or expressly accepting these Terms and Conditions of use of the website, You also accept and agree that you have read, understood, and are bound by these Terms and conditions, regardless of how you/ TNM member subscribes to or uses the TNM Services. If you do not want to be bound by the Terms and Conditions, you must not use the Website or App-Applications or the TNM Services.
Scope
Thirumana Nikah [TNM ] acts as a platform to enable any user to themselves register on it (by filling the mandatory fields and optional fields, if any) to voluntarily search for profile(s) from the database of TNM's already registered users, for seeking prospective lawful matrimonial alliances for themselves. TNM Members are provided with free/paid access for searching profiles from the database of TNM , as per the partner preference set by you (on the Website/Applications - (App)) and you shortlist the prospective alliances yourself. TNM Membership is guided by the terms and conditions mentioned herein below. By using or accessing the TNM Services, you agree to be bound by all the terms and conditions ("Agreement"): TNM does not authenticate any information of any profile and hence you as a user need to verify the credentials and information provided by other users.
1. Eligibility
a) TNM Membership and rights of admission are reserved solely for:
I. Indian Nationals & Citizens.
II. Persons of Indian Origin (PIO).
III. Non-Resident Indians (NRI).
IV. Persons of Indian Descent or Indian Heritage
V. Persons who intend to marry persons of Indian Origin.
b) Further, in capacity as an TNM member you confirm that you are:
I. 21 years or above (if you are a woman) or 24 years or above (if you are a man);
II. Legally competent to marry as per the law applicable to you (however you may register on our website/App by stating "Awaiting Thirumana Nikah Matrimony"), and
III. Not prohibited or prevented by any applicable law for the time being in force from entering into a valid marriage.
2. Registration
a. We expect that you would complete the online registration process with fairness and honesty while furnishing your personal information to TNM . You would appreciate that efficient and effective matchmaking through our automated system depends upon yourself furnishing true, accurate, current, complete information and photos, etc. We expect you to read the relevant column before keying in the details or selecting the option available or uploading the photo. You are requested not to key in details of the profile in fields other than the applicable field (including mentioning IDs of other platforms/websites/App or repeating your details in other fields, after filling them once in the relevant fields or others' photographs). You further undertake that you alone shall be responsible or liable for any information provided to TNM . In order to serve you better, if TNM requires additional details you agree to provide it. TNM shall reproduce the registered member details on an "as is as available" basis to other registered members, and TNM members shall be solely liable for the information given by such TNM member.
b. If at any point of time TNM comes to know or is so informed by a third party or has reasons to believe that any information provided by you for registration (including photos) or otherwise is found to be untrue, inaccurate, or incomplete then TNM shall have full right to suspend or terminate (without any notice) your TNM membership and forfeit any amount paid by you towards TNM membership fee and refuse to provide TNM service to you thereafter.
c. TNM Membership is restricted strictly to the registered TNM individual member only. Organizations, companies, businesses, and/or individuals carrying on similar or competitive business cannot become Members of TNM and nor use the TNM Service or TNM members' data for any commercial purpose, and TNM reserves its right to initiate appropriate legal action for breach of this obligation.
3. Role and Responsibility of TNM
a) TNM is an endeavor to help you find your dream life partner (prospect) through a process of automated searching, shortlisting, and contacting prospects amongst our registered members.
b) TNM reproduces your details once you register on our website/App on an "as is as available" basis and also shares your profile with other registered TNM members within our consortium of website(s).
c) TNM's obligation is only to provide an interface to its registered members to search their prospect themselves without any assistance from third-party/persons from amongst the other registered members of the Website/App. You agree that the system-generated search results of TNM are only of the profiles registered members on Website/App.
d) TNM's automated system offers matchmaking profiles between its registered members based on the partner preference set by each such TNM member.
e) The search conducted by any TNM member and the results thereof are automatically generated, and based on the partner preference set by you. In the event an TNM member changes their partner preference on the Website/App, then the automated system-generated prospect results of the Website/App may also undergo a corresponding change.
f) TNM cannot guarantee the complete protection of user data while it is in transit or prevent any tampering of the data by a third party with malicious intent before the data reaches the TNM servers.
4. Role and Responsibility of TNM Member
a. To protect the broader interest of the registered TNM member and increase the efficiency, TNM members ensure to keep their username and password safe and confidential for using the TNM services.
b. Any additional information/data required by TNM for using the TNM services shall be provided by the TNM Member, as and when so sought by TNM .
c. In case the partner preference is modified by the TNM member, then the automated system-generated prospect search results on the website/App may also undergo corresponding changes.
d. TNM members are requested to exercise due care and caution while shortlisting the prospect and satisfy themselves before making a choice of your match through adequate efforts, initiatives, and due diligence. TNM shall not be liable for shortcomings due to any misrepresentations made by any of its TNM members.
e. TNM Members are expected to verify the credentials of the prospect such as family status, marital status, educational qualifications, financial status, occupation, character, health status, etc.
f. To get better search results, TNM Members are expected to provide the latest photograph which should not be more than 3 months old. Providing old photographs/photographs of others, inaccurate/false information shall be treated as a violation of terms and conditions and TNM shall retain their right under clause 2 (b) of these terms and conditions.
g. TNM Members are expected to refrain from:
i. Entering into any financial transactions with prospects.
ii. Sharing confidential and personal data with each other but not limited to sharing of bank details, etc.
iii. Entering into physical relationships with any prospect before marriage.
iv. Violating any law for the time being in force.
v. Mentioning details of other matrimonial services while sending personalized messages.
h. TNM Members are expected to be cautious of prospects who ask for favors, money, etc., or call from multiple phone numbers, only interact over the phone, don't come forward for face-to-face meetings (physically or through video calls), and don't involve family and friends in matchmaking. Beware of suspended profiles status before you finalize an alliance with the prospect.
i. The TNM members agree that for getting effective search results of prospects on Website/App, you will regularly log in to the profile maintained in the Website/App and send expressions of interest which are automated messages to prospects as a free TNM member.
j. You also agree that while accessing/using the Website/App, you will be guided by the terms and conditions of the Website/App including, viewing the horoscope of prospects, and enhancing privacy settings (photo/horoscope/phone number).
k. TNM members shall not assign or transfer their TNM membership to any other person or entity, and such an act shall be treated as a violation of terms and conditions and TNM shall retain their right under clause 2 (b) of these terms and conditions.
l. If the TNM Member fails to inform TNM about any change in the particulars furnished by the TNM member to other TNM members, then the TNM membership may be suspended by TNM at its sole discretion.
m. TNM Members shall, in case of suspension or deletion of TNM membership by TNM , be entitled to forfeit any membership fee paid to TNM , and with the right to claim damages for misrepresentation, etc., in terms of clause 2(b) hereinabove, and TNM reserves its right to initiate appropriate legal proceedings against such TNM member.
n. TNM Members shall use the TNM services only for lawful purposes and for seeking lawful matrimonial alliances. You represent and warrant that you have not been previously convicted of any criminal offense or have no criminal proceeding pending against you. TNM reserves the right to initiate appropriate legal proceedings at its own cost against you if you are found to be in breach of this obligation.
o. TNM Members agree to refrain from using language or sharing any material that is inappropriate, offensive, or harmful when interacting with other members. Any violation of this will result in the termination of membership and potential legal action.
5. Privacy of Membership
To protect your privacy and understand our practices as amended from time to time, please read and follow our Privacy Policy, which also governs your visit to Thirumana Nikah Matrimony (TNM ) and associated TNM Services.
6. Disputes between TNM Members
a. You and TNM members are solely responsible for your interactions (including any disputes) with other TNM Members. TNM reserves the right but has no obligation, to monitor disputes between you and other Members.
b. In case TNM member(s) have any disputes with another member(s), then you shall pursue such disputes independently and TNM shall not be responsible, nor will it provide any assistance, in any such dispute.
7. Refund Policy
TNM Membership is non-refundable in nature, and any refund request will be handled at the sole discretion of TNM .
8. Limitation of Liability
TNM cannot guarantee the accuracy, integrity, or quality of the information, material, or content posted by members on the Website/App and will not be liable for any inaccuracy, error, or omission in any information, material, or content, or any data available on the Website/App.
9. Indemnity
You agree to indemnify and hold TNM harmless from any claims, losses, liabilities, or expenses (including legal costs) arising from your use of the Website/App or any breach of this Agreement by you.
